Terms and Conditions

Retainers, Deposits, Payments 

1. The date of the event is considered “booked” upon receipt of a non-refundable deposit equaling to 30% of the total value of the 

    cake, delivery charges, equipment deposit and signed contract.

2. The final payment is due 2 weeks prior to event which includes delivery charges, equipment deposit etc.

3. If the order is booked less than 2 weeks before the event a full payment is required. (We do charge the last minute order fee.)

4. If the Client fails to make the full payment 2 weeks prior to the event, M5 Bakes will cease work, the order will be cancelled and

    no refund will be given.

5. Payments can be made via e-transfer ( or cash. Processing fees for credit card payments will be charged to the client.


  1. M5 Bakes is not responsible for bodily injury, property or consequential damage, which may result from services not provided by M5 Bakes.

  2. M5 Bakes is not responsible for any damage to the cake or shortage of cake caused by anyone NOT employed by M5 Bakes who is responsible for the cake in any way.

  3. M5 Bakes will not make or deliver the orders if payments have not been paid in full.

Fulfillment of Contract

  1. M5 Bakes is not responsible for any delay or inability to deliver based on accidents, natural disasters, transportation issues, inclement weather, illness, death, labor troubles, delay in supplies, disputes or strikes, or any other circumstance beyond M5 Bakes control.

  2. Some cakes/products are either too large or irregularly shaped to fit in a cake box so you need to take special care to protect them. Once the client picks up the cake, the client assumes all liability and responsibility for the condition of the cake/products. M5 Bakes no longer assumes any responsibility for damage caused to the cake/products.

Change or Cancellation

  1. The Client must notify M5 Bakes if there is a change in the date of the event or change in the order 2 weeks prior to the date of the event.

  2. If a cancellation of the event occurs 2 weeks prior to the date of the event, all money will be refunded minus the non-refundable deposit.

  3. If a cancellation occurs within the 2 weeks of the event, you will be refunded 50% after we minus the non-refundable deposit.

  4. Any changes regarding the size, flavor, design must be submitted 2 weeks prior to the event. Any changes requested after this date cannot be guaranteed and may be subject to additional charges.

  5. If there is a 'no show' or the client does not come to pickup of the cake/products, no refund will be given.

Design of the Cake

  1. M5 Bakes will follow the client’s requests closely to create the cake/products desired.

  2. M5 Bakes cannot duplicate an exact copy of another cake artist’s work but will take ideas from the reference pictures provided.

Allergy & Dietary Warnings

  1. M5 Bakes's baked goods may contain or have come in contact with milk, wheat, nuts, soy, dyes, flavorings, sugar, artificial sweeteners, artificial colors and other allergens not listed.

  2. The client is responsible to inform us of any allergies or restrictions at the time of ordering. M5 Bakes is not responsible for asking the client. There will be no refunds given once the cake /products are made.

  3. The client is responsible and agrees to notify their guests of the potential allergy hazards and risks and holds M5 Bakes harmless for any type of allergic reaction caused.

  4. M5 is not a nut-free facility and therefore we cannot guarantee our product to be nut-free, but we will take every possible precaution to avoid cross contamination.

Flowers, Ornaments & Special Equipment

  1. All ornaments and special equipment needed is the responsibility of the client. All personally supplied items must be submitted to M5 Bakes 2 weeks prior to the event.

  2. Topping cake/products with ornaments that are too heavy or not secured properly may cause damage to your cake/products. If any party, other than M5 Bakes, adds it to a cake, we are not responsible for damage to the ornament or to the cake/products.

  3. We are always more than willing to decorate your cake with fresh flowers or lay your flowers around the base of the cake/products. If you have a specific layout you should give us a sketch of exact placement. Flowers for the cake/products, table (or anywhere else) need to be provided by your florist.

  4. The client is responsible and agrees that fresh flowers are not a food product and may contain pesticides, insects, dirt or other contaminants and holds M5 Bakes harmless for any type of contamination or illness caused.

Delivery and Set Up

  1. There is a delivery fee of $2 - $3 per kilometer from M5 Bakes location depending on the size and products being delivered.

  2. The setup fee is $35 per hour per person. Setup will be done for cakes/products made by M5 Bakes only.

  3. M5 Bakes is not responsible for tardiness if the venue is changed within 48 hours of the event.

  4. The client may pick up the cake/products. The client assumes liability once it passes into the client’s possession. We recommend placing all items on a flat area of your vehicle, on non slip mats, with air conditioning flowing around the cake/products.

  5. The client is responsible for providing a suitable environment for the cake/products, a study table, optimal temperature, away from heaters, vibrations, people, suitable surface, suitable outdoor setting. The client is responsible to ensure the needed conditions for the cake/products is provided. M5 Bakes is not responsible for cake/products once set up including collapse, melting, pokes etc.


  1. M5 Bakes reserves the right to photograph the cakes/products made by us.

  2. M5 Bakes reserves the right to use all photographs of the cake/products for display, promotion, advertising purposes or for any other use without compensation to the client.
